No Compromise 2A Organization NAGR Files Lawsuit Against the City of San Jose Over its Anti-Gun Ordinance

In politics, there are few organizations that can be trusted to faithfully carry out their constituents’ legislative desires. Most talk a big game about freedom, but fail to deliver the goods when push comes to shove. Some of these organizations end up just being total fundraising operations that do nothing to change public policy.

This cannot be said about the National Association for Gun Rights. NAGR is one of the leading Second Amendment organizations in the nation, which has become renowned for its advocacy for Constitutional Carry — the idea that any lawful individual can carry a firearm without a permit.  But that’s not all of the advocacy that it does.

For example, it has recently taken on more legal battles nationwide. On January 26, 2022, the National Association for Gun Rights teamed up with its legal arm, the National Foundation for Gun Rights to file a lawsuit against the City of San Jose, the San Jose City Council, and Jennifer Maguire, the City Manager of San Jose. 

At the center of this legal dispute is a challenge being launched against a new ordinance the San Jose City Council passed which compels gun owners to buy liability insurance and pay an annual fee to own firearms. 

On January 25, the San Jose City Council passed the ordinance on a 8-3 vote. 
 
“We promised we would sue the City of San Jose if they actually passed this ridiculous tax on the right to keep and bear arms, and now we’re fulfilling that promise,” declared Dudley Brown, President of the National Association for Gun Rights. “To tax a constitutional right is absolutely preposterous and places an undue burden on law-abiding gun owners. Do the members of the San Jose City Council actually believe this will do anything to stop crime?”
 
Back on July 15, 2021, the National Foundation for Gun Rights sent a cease and desist letter to the San Jose City Council calling on the city to stop pushing the anti-gun ordinance:
 
"A right that you have to pay a tax to exercise is not a right at all. You would not dream of imposing a tax to attend a church or to disseminate or read a newspaper, which are protected by the First Amendment,” said Hannah Hill, Policy Director for the National Foundation for Gun Rights. “This is why the Foundation exists – to stand up to bullies like the City of San Jose and their tyrannical ordinance which will harm law-abiding citizens and set an ugly precedent for gun control laws all across the nation.”

California is largely a lost cause when it comes to pushing for statewide pro-gun policies. Nevertheless, wrenches can be thrown in the legal system in order to push back against gun grabs at the local level.

These kinds of local initiatives are how gun controllers gain momentum. By stopping them at the local level, pro-gun forces can at least delay gun control tidal waves. Because let’s face it: The stuff that gun controllers want to pass at local level will eventually be scaled up as statewide policy should they have their way.

These people are relentless, which necessitates an equally vigorous form of opposition to them.
