Federal Court Rules Against Texas’ Carry Ban for Adults Under 21

On August 25, 2022, United States District Judge Mark T. Pittman ruled that Texas’ law banning adults under the age of 21 from carrying handguns was unconstitutional. Pittman was appointed by former President Donald Trump.

Pittman argued that the age limit was an infringement on the Second Amendment. He argued that the Constitution didn’t impose an age restriction on the right to bear arms.

“The issue is whether prohibiting law-abiding 18-to-20-year-olds from carrying a handgun in public for self-defense is consistent with this Nation’s historical tradition of firearm regulation,” Pittman wrote. “Based on the Second Amendment’s text, as informed by Founding-Era history and tradition, the Court concludes that the Second Amendment protects against this prohibition."

This decision won’t go into effect immediately. Pittman issued a 30-day stay pending appeal. The Trump-appointed judge believes that a higher court could issue a different ruling.

Though if the ruling stands, firearms regulations would be further relaxed in the Lone Star State. In the past ten years, Texas has gone in a pro-gun direction as witnessed by its passage of open carry, campus carry, and Constitutional Carry. In the case that this ruling stands, Texas’ pro-gun profile will further improve.

Such a ruling is long overdue for Texas. It’s amusing how individuals are allowed to join the military at 18 to die in some foreign war that serves the military-industrial complex’s interests. But when it comes to exercising your God-given right to bear arms, you’re going to have to wait a few years after becoming an adult.

Talk about a perverse and arbitrary standard. Thankfully, America is going through a pro-gun wave in policy that’s correcting many of its flawed gun control laws and regulations. Let’s hope this trend continues accelerating in the next decade and beyond.

The destruction of the gun control regulatory state is long overdue.
